Today the agenda for next week's DAU has been published on the council website. This document shows what are all the neighbours objections and what is the proposed decision for our DA.
The good news is that the proposal is to approve the DA. The bad news is that it includes some conditions we are not happy with. I am sure I can find some other way to achieve the same intent without these conditions. Problem is we don't have time to discuss. If we pull out of next week DAU we will have to wait until February to revisit our case. That's going to be costly as our contract has already expired (we will have to pay Metricon 0.5% extra per month of delay).
Most of the neighbours objections are deemed as having no ground simply because we already comply with the council DCP (Development Control Plan). For instance they complain about our building height, 7.2 metres, when the maximum allowed is 10 metres. Why people don't check the DCP before submitting an objection?
Other objections are quite valid, like the privacy concerns or shadowing. Our proposed building already tries to minimise any impact on neighbouring properties (we provide ample side setback, more than double the minimum required) but at the end of the day we are building in a suburban block, not on acreage.
Some of the rest is unjustified. On that list we have one neighbour saying the noise from our air-conditioning unit, which over 3 metres away from their boundary fence, will impact them when they themselves have two compressor mounted directly on their own walls!
Some people just amaze me - where on earth do they think they are building? Its a new estate right?
ReplyDeleteWhere they have just built themselves recently?
Like you say - its not acreage so some of the objections are just ridiculous!!
I think its incredible that people object to the height when it is well under what the DCP allows - do they really expect, in a new area, only single storey houses will be built?
Crazy!
Good luck at the DAU - I hope your have a favourable outcome and a quick resolution.
